About these terms

These terms apply when you use thefumist.com and when you buy from us. The website and the brand are run by M/s B.S. Agencies (“The Fumist”, “we”, “us”). When you place an order, you agree to these terms, our Privacy Policy, our Refund & Cancellation policy and our Shipping & Delivery policy.

To place an order you must be at least 18 years old, or be using the site with the involvement of a parent or guardian.

Our fragrances

Every Fumist fragrance is made in India. We describe each one as accurately as we can: its notes, its character and its size. Please keep in mind:

• A fragrance smells different on different skin. How long it lasts and how far it carries depend on your skin, the weather and how much you apply. Descriptions of notes, longevity and projection are a guide, not a promise.
• Photographs are real, but colours can look slightly different on your screen. Packaging may change from time to time.
• Our perfumes are alcohol-based and flammable. Keep them away from flames, heat and direct sunlight. Keep them out of reach of children, and away from the eyes.
• For external use only. If you have sensitive skin or known allergies, check the ingredient list on the box and try a small amount on the inside of your wrist first. Stop using it if irritation appears.

Prices and offers

• Prices are in Indian rupees (₹) and include all taxes. Where we show a maximum retail price (MRP) and a lower price, you pay the lower price.
• Shipping within India is free on every order. You will always see the full amount before you pay.
• Introductory prices and offers last for a limited time. We may change prices at any time, but a change never affects an order that has already been paid for.
• If a clear mistake is made in a price (for example, a bottle listed at a fraction of its real price), we may cancel the order and refund you in full. We will tell you before we do this.

Orders

Your order is placed when you complete payment at checkout. We then send a confirmation email with your order reference. You can also view your order on our website at any time using the link in that email.

In rare cases we may be unable to fulfil an order. This could be because a fragrance is out of stock, we cannot deliver to your pincode, or we suspect the order is fraudulent. If so, we will tell you and refund the full amount to your original payment method.

You can buy up to 10 of any one item in a single order. For larger quantities, wholesale or corporate gifting, please contact us.

Payment

We accept UPI, debit and credit cards, net banking and wallets through Cashfree Payments, an RBI-authorised payment aggregator. Your payment details go directly to Cashfree over an encrypted connection. We never see or store your card number, CVV, UPI PIN or banking passwords.

We currently accept prepaid orders only. Cash on delivery is not available.

If money leaves your account but your order does not show as paid, please do not pay again. Payments that fail at the bank’s end are usually reversed automatically within 5–7 working days. Write to us with your order reference and we will check it for you.

Delivery

We deliver across India. Dispatch times, delivery estimates and tracking are explained in our Shipping & Delivery policy. Delivery dates are estimates. Couriers can be delayed by things outside our control, such as weather, strikes or restrictions on moving goods. Please check your parcel when it arrives, and tell us about any damage within 48 hours.

Cancellations and returns

You can cancel an order before it ships, and return unopened bottles within 7 days of delivery. Damaged or incorrect items are replaced or refunded. The full details, including how refunds reach you, are in our Refund & Cancellation policy.

Using this website

Please use this website only for lawful purposes. Do not try to interfere with how it works, gain access to parts of it that are not public, scrape it in bulk, or use it to send spam or harmful code. Please give accurate details when you order or contact us. We may refuse service to anyone who misuses the site.

The site may link to other websites, such as Instagram, WhatsApp or our payment provider. We are not responsible for their content or practices.

Our brand and content

The name The Fumist, our logo and monogram, fragrance names, product photographs, bottle and packaging designs, and all text on this site belong to M/s B.S. Agencies. They may not be copied, reproduced or used commercially without our written permission. You are welcome to share links to our pages.

Our responsibility to you

We stand behind every bottle we send. If something goes wrong with your order, our responsibility is to put it right: by replacing the item or refunding what you paid for it. To the extent the law allows, we are not responsible for indirect losses. Nor are we responsible for reactions caused by using a product against the guidance on its label or above.

Nothing in these terms limits your rights under the Consumer Protection Act, 2019, or any other rights the law gives you that cannot be excluded.

Law and disputes

These terms are governed by the laws of India. If a disagreement comes up, please write to us first. Most things can be settled quickly and fairly. Otherwise, the courts at New Delhi have jurisdiction. This does not affect your right to approach a consumer commission.

Complaints

If you are unhappy with anything, write to our Grievance Officer, Shilpa Kandhel, at info@thefumist.com with your order reference. We acknowledge every complaint within 48 hours and resolve it within one month of receiving it. This is in line with the Consumer Protection (E-Commerce) Rules, 2020.

Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they last changed. The version in force when you placed your order is the one that applies to that order.
